The following terms of use (the "Terms of Use") contains the terms and conditions applicable to you and your access to and use of our colligors.com website, including its mobile version (collectively, the "Website"), and our mobile application to be released later (the "App"), if applicable, in each case regardless of how accessed (collectively, the Website and the App are referred to as the “Colligors.com”). Colligors.com is developed, owned and operated by Colligors LLC. (“Colligors”), a company established under the Hungarian law, having a business address in Europe, Hungary 2143 Kistarcsa, Alig str. 9. having registered under EUID: HUOCCSZ.13-09-242633 in the trade registry kept by the Court of Justice in the Budapest area, EU Tax ID: HU32893119 (hereinafter referred to as: “Colligors”, or "we", "us", "our"). Your use of Colligors.com (and any other feature, content or application offered by us) is at all times subject to this Terms of Use, as the same may be modified by us, and all applicable EU and Hungarian laws, rules and regulations. Please read this Terms of Use carefully!
If you are dissatisfied with this Terms of Use or Colligors.com, your sole and exclusive remedy is to discontinue using Colligors.com. Colligors.com is subject to the relevant EU and Hungarian law as governing law, we provide our service as intermediary service (hosting) provider under the REGULATION (EU) 2022/2065.
Our website is hosted by Hetzner Online GmbH. (Industriestr. 25 91710 Gunzenhausen, Germany, EU; https://www.hetzner.com/unternehmen/ueber-uns/).
1. Acceptance of this Terms of Use.
BY ACCESSING AND USING COLLIGORS.COM, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE LEGALLY BOUND BY THIS TERMS OF USE. If you do disagree to be bound by this Terms of Use, you may not access or use Colligors.com.
2. Use of Colligors.com.
The content and information posted by us on Colligors.com may be used only for informational, personal or other purposes authorized by us. By accessing and using Colligors.com, you represent and warrant that: (a) all information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older; and (d) your use of Colligors.com does not violate any applicable law, rule or regulation. Colligors.com are intended for worldwide use and you agree to use Colligors.com in accordance with relevant EU and Hungarian law. Use of and access to Colligors.com is void where prohibited.
3. Unauthorized Use of Colligors.com
You may not use Colligors.com for any unauthorized use or for any illegal or unlawful purpose. Any unauthorized use or violation of this Terms of Use may immediately and automatically terminate your right to use and access to Colligors.com and may subject you to legal liability. You acknowledge and agree that you access to these external sites at your own risk and are fully responsible for use or interaction with these external sites. We strongly advise to read the terms and privacy policies of the external sites you access to.

You agree to our collection, processing, use and sharing of your information, including personal information, as set forth in our privacy policy ("Privacy Policy”).
6. Collection Items, Content and Specifications.
The inclusion of any collection item (“product”) or services on Colligors.com does not imply or warrant that these products or services will be available at any particular time or that the listed attributes are accurate or complete. The actual colour of product you see will depend in part on your computer system and settings, and we cannot guarantee any colour or material or detail of actual product will be accurate. We do not endorse and have not verified the accuracy or reliability of any opinion or statement made on Colligors.com by any third party, including but not limited to users, dealers, advertisers of products and services available under Colligors.com.
7. Get a Membership
If you want to explore what Colligors and other users may to offer, you need a membership. Services and details of the different types of memberships are available under http://colligors.com/get-membership. Once you select your plan and get your Membership, we ask you to provide us with your email address and to choose a secure password. By selecting a membership plan, you are making a contractual relationship with us.
8. Fees and Payment
Certain services are available at Colligors.com are accessible only for a fee. Fees and services are subject to the plan as disclosed on http://colligors.com/get-membership. We may change the fees and/or the services available according to the plan from time to time. Any changes in fees and/or services will be announced on Colligors.com or via email to be sent to you. Our fees are subject to the EU and the Hungarian VAT taxation and determined in USD currency.
You will pay and authorize us to charge the applicable fees on your bank card using payment method offered by Barion as our independent payment service provider.
If you select a renewal subscription for your membership, the fee will be charged a month from the day of payment in case of monthly subscription, 6 months in case of a six-month subscription, and 12 months in case of an annual subscription. Renewals will be charged until you cancel them. You may cancel the renewal by clicking the “Stop auto renewal” button in your “Edit profile / My subscription (not public)” menu or by cancellation of your membership.
Online bank card and other payment methods are implemented through the Barion system. We will not receive your card or other payment-related data. Barion Payment Inc., the provider of the service, is an institution under the supervision of the National Bank of Hungary, its license number: H-EN-I-1064/2013. Your bank statement will show Barion Payment Inc. as the place of acceptance.
Fees are up-front and may not be refundable except as required by the governing law.
If you set auto renewal (or recurring payment) or have a Visitor Membership for a limited free 14 days trial period, we may automatically charge at the end of the trial or for the renewal, unless you cancel your membership or disable the automatic renewal or recurring payment. We will keep you informed on every auto renewal.
You are solely responsible for setting complete and accurate billing and contact information in your profile.
You are solely responsible for all taxes, duties and other similar charges, imposed because of its receipt of services under this Terms of Use, including without limitation sales, use, and value-added taxes.
9. Limitation of liability
Please keep in mind that items shared via Colligors.com are generally not intended to offer for sale, Colligors.com is not a trading platform or auction site, so we don’t facilitate or participate in transactions between our users. If you get a Dealer Membership, you may have trader eligibility, so you can share your collections with prices and get connections to other users for trading purposes, but also keep in mind, that your transaction is made outside of Colligors.com.
10. Intellectual Property Rights.
All content of Colligors.com (including, without limitation, text, graphics, icons, images, clips and software) is protected by copyright, trademark, and other laws. Names, logos, taglines, icons and marks on Colligors.com are the exclusive property of us or we have the exclusive license to use them. All rights reserved and may not be used by you without our prior written and expressed permission. Unless otherwise indicated, all other intellectual property appearing on Colligors.com is the property of its respective owner. We reserve all rights not expressly granted in and to Colligors.com' content and services. Under this Terms of Use we grant limited licence to you to use our catalogue images only to use them on Colligors.com.
11. User Content.
Users may be able to post content in certain areas on Colligors.com or on other websites or platforms that we own or operate, including on social media platforms such as Facebook, Instagram, X, TikTok, LinkedIn and so on (“Social Media Sites"). You are solely responsible for any content (including, without limitation, photos, artwork, videos, text, graphics, and other information) you upload, post, display or otherwise provide to us through Colligors.com or Social Media Sites ("User Content"). Any User Content you post or provide, including any questions, reviews, comments and suggestions, will be treated as non-confidential and non-proprietary.
By sharing User Content with us, you grant us a worldwide, royalty-free, perpetual, irrevocable and transferable right to use, copy, reproduce, perform, distribute, display, publish, sell, and create derivative works of, the User Content, and to grant and authorize sub-licensees of the foregoing. Additionally, we shall be free to use any ideas, concepts, know-how or techniques contained in such User Content for any purpose whatsoever, including, without limitation, developing, manufacturing and marketing and services which incorporate such User Content. You represent and warrant that: (a) you own the User Content uploaded by you to Colligors.com or otherwise have the right to grant the license set forth herein; (b) your User Content does not violate privacy rights, publicity rights, intellectual property rights, or any other rights of any person or entity; and (c) by uploading your User Content to Colligors.com does not result a breach of any contract between you and a third party.
You agree that you will not use a false or misleading email address, impersonate another person or entity or otherwise mislead with respect to any User Content. You agree to pay for all royalties, fees and other payables owing to any person by reason of any User Content you upload to Colligors.com.
Though we are not requested by the governing law to filer or monitor the User Content but may review User Content from time to time at our sole discretion to review compliance with this Terms of Use. We may reject, refuse to upload, edit or remove any User Content at any time without notice, for any or no reason.
12. Notice per DSA.
Third party content (including User Content) may be made available via Colligors.com by users and other third parties are not within our control. However, we respect the copyright and trademark or other intellectual property rights of the rightholders and we maintain a notice and action mechanism under the respective DSA regulation. Rightholder or its representative may lodge its notices shall be addressed only by electronic means to our Other inquires contact point published on https://colligors.com/contact. Please keep in mind, that we may remove User Content upon the notice by the rightholder.
13. Suspension and Termination of Access and/or Membership.
If you (i) violate this Terms of Use, ie. by unauthorized use as it is set forth herein or (ii) use Colligors.com in a manner that we reasonably believes that it may harm this Terms of Use, we are entitled to suspend or terminate your access to Colligors.com.
Notwithstanding anything in this Term of Use, if there is any Emergency Situation we may automatically suspend your access to Colligors.com without any notice. We will make its commercially reasonable efforts to limit the suspension as needed due to Emergency Situation. "Emergency Situation" means: (i) use of Colligors.com that may disrupt the our service, or the infrastructure used to provide our service and (ii) unauthorized third-party access to the Colligors.com.
14. Term.
This Terms of Use shall remain in force and effect while you use or access to Colligors.com or have a Membership in Colligors.com. You can cancel your membership at any time, so your membership will not be renewed for the next period and will expire on the renewal date.
FOR EU CITIZENS ONLY: NOTWITHSTANDING THE ABOVE, IF YOU USE THE COLLIGORS.COM AS A CONSUMER AS DEFINED BY APPLICABLE LAW, YOUR RIGHT OF WITHDRAWAL UNDER THAT LAW IS EXERCISED BY CANCELING THE 14 DAYS FREE TRIAL PERIOD, AND YOU WILL HAVE NO FURTHER RIGHT OF WITHDRAWAL ONCE THE FREE TRIAL PERIOD CONVERTS TO A PAID SUBSCRIPTION OR IF THE PAID SUBSCRIPTION IS AUTOMATICALLY RENEWED.
15. Indemnity.
You agree to defend, indemnify and hold us, our subsidiaries, shareholders, affiliates, suppliers, and licensors and each of our respective officers, agents, partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, due to or arising out of (1) your use of Colligors.com in violation of this Terms of Use and/or arising from a breach of this Terms of Use (including, without limitation, any breach of your representations and warranties set forth herein) (2) any allegation that any content or other material you have submitted or transmitted to Colligors.com infringe, misappropriate or otherwise violate the copyright, trademark, other intellectual property right, trade secret, know-how or other rights of any party; (3) your violation of applicable law, and / or (4) your activities or omissions in connection with Colligors.com.
16. DISCLAIMER OF WARRANTIES.
YOUR USE OF COLLIGORS.COM IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ARE RESPONSIBLE FOR COMPLYING WITH THIS TERMS OF USE AND ALL APPLICABLE LAWS WITH RESPECT TO THE USE OF COLLIGORS.COM. EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN THIS TERMS OF USE, ALL INFORMATION AND CONTENT MADE AVAILABLE ON OR ACCESSED THROUGH COLLIGORS.COM, ARE MADE AVAILABLE TO YOU ON” AS IS" BASIS WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND. FURTHER, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OF COLLIGORS.COM, THEIR CONTENTS AND THE COLLECTION ITEMS LISTED ON COLLIGORS.COM. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN COLLIGORS.COM OR ANY MATERIALS OR CONTENT CONTAINED THEREIN WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT COLLIGORS.COM OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR THE USE OF COLLIGORS.COM, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN. THIS DISCLAIMER CONSTITUTES AN ESSENTIAL PART OF THESE TERMS.
17. LIMITATION ON LIABILITY.
IN NO EVENT SHALL THE COLLIGORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF GOODWILL, LOSS OF REPUTATION, COST OF COVER DAMAGES OR INTANGIBLE LOSSES OF ANY KIND ARISING FROM YOUR USE OF COLLIGORS.COM, YOUR INABILITY TO USE COLLIGORS.COM, OR THE COLLECTION ITEMS UPLOADED TO COLLIGORS.COM, EVEN IF THE COLLIGORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18. Third Party Transactions.
Through your use of Colligors.com, you may have the opportunity to engage in commercial or other transactions with other users, partners and other third parties. You acknowledge that all transactions relating to any merchandise or services offered by any third party, including but not limited to the purchase terms, payment terms, warranties, guarantees, maintenance and delivery terms relating to such transactions, are agreed to solely between the third party seller or purchaser of such merchandise and services and you, and that you will look solely to such third party to enforce any of your rights.
In the event of any problem with the products or services that you have purchased from a third party or other user you agree that you will address such issues solely to such third party or user. We may not have the ability to accept returns or refund the purchase price for any transaction you complete with a third party through Colligors.com. ANY WARRANTY THAT IS PROVIDED IN CONNECTION WITH ANY PRODUCTS, SERVICES, MATERIALS OR INFORMATION AVAILABLE ON OR THROUGH COLLIGORS.COM FROM A THIRD PARTY IS PROVIDED SOLELY BY SUCH THIRD PARTY AND NOT BY US.
19. Changing this Terms of Use
This Terms of Use may be prospectively changed, modified, or altered (“changed”) by us in our sole discretion at any time. If we change this Terms of Use, we will keep you updated via notice, sent to your email address set in your profile, prior to or upon the change(s) becoming effective. Accordingly, when you access or use Colligors.com, you should check the date of the Terms of Use and be aware of any changes since the last version. Your continued use of Colligors.com following the posting of any changes to this Terms of Use means that you accept such changes. Your access to and use of Colligors.com will be governed by the Terms of Use in effect at the time of such access or use.
20. Governing Law.
This Terms of Use and your use of Colligors.com will be governed by the EU and the Hungarian law regardless of the conflict of law provisions thereof and regardless of where you live or from where you access or use Colligors.com.
21. Legal remedies.
Any legal disputes that may possibly arise in relation to or from this Terms of Use shall be exclusively settled by the Hungarian court being competent and having jurisdiction as per the registered business seat of Colligors.
If you are a Hungarian resident, and you are a consumer, you may submit your claim either to the court or the dispute resolution body, you can find the competent resolution body per your address at https://bekeltetes.hu/udvozlo.
If you live outside of Hungary, but are located in an EU Member State, or the United Kingdom, Iceland or Norway, you can contact the European Consumer Centre: https://www.eccnet.eu in order to settle your cross-border individual consumer complaint.
22. Miscellaneous.
This Terms of Use, together with any additional terms and conditions or policies referred to and incorporated herein (including the Privacy Policy and/or additional terms applicable to various parts of Colligors.com), constitute the entire agreement between you and us. For the avoidance of doubt, this Terms of Use apply solely to the extent permitted by law.
Our failure to exercise or enforce any right or provision of this Terms of Use shall not be construed as a waiver or relinquishment to any extent of its right to enforce such terms or rights on any future occasion.
The section titles in this Terms of Use are for convenience only and have no legal or contractual effect.
This Terms of Use and your membership on Colligors.com are for personal use to you and you may not transfer or assign your membership. We may not assign the contractual relationship under this Terms of Use or any rights or obligations under herein or any other legal documents made by the you and us in relation to the subject of this Terms of Use without providing notice to you, except we may assign this contractual relationship or any rights or obligations set forth herein or any other legal documents made by you and us in relation to the subject of this Terms of Use or any rights or obligations under thereof to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets without providing notice. Any other attempt to transfer or assign is void.
Our performance under this Terms of Use is subject to the governing law and legal process, and nothing contained in this Terms of Use is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of Colligors.com or information provided to or gathered by us with respect to such use.
If any part of this Terms of Use is deemed to be illegal, invalid, void or for any reason unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.
Neither party shall be liable to the other for any delay or non-performance of its obligations under this Terms of Use arising from any cause or causes beyond its reasonable control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, civil commotion, industrial dispute of a third party, riots, embargoes, hackers, viruses, denial-of-service attacks, Internet disturbance or any other event beyond its reasonable control ("Force Majeure Event"). Subject to the party so delaying promptly notifying the other party in writing of the reason for the delay and the likely duration of the delay, the performance of the delaying party's, obligations, to the extent affected by the delay, shall be suspended during the period that the cause persists and each party shall use all reasonable endeavours to avoid the effect of that cause provided that if performance is not resumed within 30 days of that notice, the non-delaying party may by notice in writing terminate this contractual relationship. Neither party shall have any liability to the other in respect of the termination of this Terms as a result of a Force Majeure Event.

You hereby acknowledge and consent that such notices will be effective upon our posting them on Colligors.com or (if we choose to do so in our sole discretion) delivering them to you through email if you have provided us with your accurate email address.
24. Export restrictions
The export and re-export of our service may be subject to applicable export restrictions or embargo. Our service may not be used in the country that is subject to an embargo or export restriction by Hungary or the European Union, and you must not use the services under this Terms of Use in violation of any export restriction or embargo by the applicable jurisdiction. In addition, you must ensure that we are not provided to anyone is subject to applicable export restriction or embargo.
